Privacy Policy

Nourish Her Nutrition (ABN 94 255 194 996) (“we”, “us”, “our”) is committed to protecting your privacy. This policy explains how we collect, use, store, disclose and protect your personal information, and how you can access, correct or complain about it.

We are a private telehealth dietetics practice run by an Accredited Practising Dietitian (APD). As a health service provider we are bound by the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs), regardless of our size.

1. The information we collect

Because we provide health services, much of what we collect is sensitive information (health information), which is given a higher level of protection under the Privacy Act. Depending on your interaction with us, we may collect:

  • Identity and contact details — your name, date of birth, address, email, phone number and, where relevant, your GP or referring practitioner.
  • Health information — your medical history, presenting conditions, medications, allergies, dietary intake, anthropometric measurements, pathology and test results, treatment goals and clinical notes.
  • Government identifiers — your Medicare number, DVA number or other identifiers where relevant to claiming or care.
  • Financial information — the details needed to process payment and rebate claims. Card payments are handled by our third-party payment provider and we do not store your full card details.
  • Referral and care-team information — referral letters and correspondence with other members of your care team.
  • Website and technical information — see section 9.

2. How we collect it

We collect personal information directly from you wherever possible — through enquiry and intake forms, during consultations, and in written or verbal communication. We may also collect information from third parties such as your referring GP or other treating practitioners, where you have consented to this or where it is reasonably necessary for your care.

3. Why we collect it, and consent

We collect and use your information to provide dietetic care, communicate with you, manage appointments, process payments and Medicare/private health fund claims, maintain accurate clinical records, meet our legal and professional obligations, and improve our services.

We collect sensitive (health) information only with your consent and only where it is reasonably necessary for providing you with dietetic services. By providing this information and engaging our services, you consent to us handling it as described in this policy.

4. How we use and disclose your information

We use your information for the purposes described above. We may disclose it:

  • to other members of your care team (such as your GP or referring practitioner), with your consent, to support coordinated care;
  • to Medicare, the DVA and private health funds for the purpose of processing rebates and claims you have asked us to make;
  • to third-party service providers who help us run the practice — including our practice management software, payment processing and secure communication providers — who are bound to protect your information;
  • where required or authorised by law, or where necessary to lessen a serious threat to life, health or safety.

We will not sell your personal information, and we will not use it for a purpose unrelated to your care without your consent, unless the law permits or requires it.

5. Overseas disclosure

Some of the service providers we use — including our email provider — may store or process data on secure servers located outside Australia. Where this occurs, we take reasonable steps to ensure your information is handled consistently with the Australian Privacy Principles.

6. Data security

We take reasonable steps to protect your information from misuse, loss, unauthorised access, modification or disclosure. These include secure, access-controlled clinical software, encrypted communication where practicable, password protection, and conducting telehealth consultations in a private setting. No system is completely secure, and we cannot guarantee absolute security of information transmitted over the internet.

7. Data breaches

We comply with the Notifiable Data Breaches scheme. If a data breach occurs that is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by law.

8. Accessing and correcting your information

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. To do so, contact us using the details below. We will respond within a reasonable time. In limited circumstances permitted by law we may decline access, in which case we will explain why.

9. Our website, cookies and analytics

When you visit our website, we may collect limited technical information such as your IP address, browser type and pages visited, including through cookies and analytics tools such as Google Analytics. This helps us understand how our site is used and improve it. You can disable cookies in your browser settings, though some features may not work as intended.

10. Direct marketing

We will only send you marketing or newsletter communications where you have opted in, and every such message will include an easy way to unsubscribe. This is consistent with the Spam Act 2003 (Cth).

11. How long we keep your information

We retain your clinical records for as long as required by law and professional standards. As a general standard for health records this is at least 7 years from your last contact with us, or, for a person who was a child at the time of the record, until they turn 25. After that, records are securely destroyed or de-identified.

12. Complaints

If you have a concern about how we have handled your personal information, please contact us first using the details below so we can try to resolve it. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992.

13. Changes to this policy

We may update this policy from time to time. The current version will always be available on our website, and the “last updated” date shows when it last changed.
